The Legal Requirements involved In Company Formation

Setting up a limited company is certainly not an easy feat and it is almost inevitable that many aspiring entrepreneurs will find starting up their own business a very daunting process. Opening a new organisation involves making corporate plans for both the short term and long run, making key financial decisions and completing a series of legal procedures.

Such tasks are undoubtedly involving and if you are in any doubt about company formation, it is important to make sure you seek the guidance of experienced professionals like us, here at Formations Direct. In terms of legal procedures, there is an extensive array of activities that require your attention during the limited company registration stage to help you avoid risking being on the wrong side of the law before even entering the market you want to conquer eventually.

Company Name: Prior to registering as a limited company, it is essential that you choose a name for your organisation as this is a legal requirement. Common law and company law require business people to carefully choose company names and avoid branding their company with a name that is the same or very similar to other organisations’ names. Apart from the legislative side, your company name is your label so it is important to choose a name that is relevant to your services, easy to spell and in modern days, web friendly.

Company Director: The company formation and registration regulating body, the Companies House insists that every limited company should have at least one person registered as the company director although there is no limit to the number of registered directors. Under written laws, a company director cannot be anyone under the age of 16 years old. One of the main roles of the director is to make sure the company is operating to its full capabilities while abiding by all laws of the land.

Office Address: it is important to clearly state the location of your organisation when registering. Once you have completed the registration process, your company’s address will go into the public register for companies. You can register you residential address as the company address, and technically may be in breach of your mortgage, but you may wish to avoid publicising your home address to reduce the chance of unwarranted attention or unwanted visitors.

There are many other legal requirements that need following when registering your company. As mentioned earlier, this process can be tough so it is advisable to consult us. Here at Formations Direct, we offer a fully comprehensive company formation guidance procedure including company name checking facilitated by our professional and fully qualified employees.
